Following the Brexit vote, there is a great deal of uncertainty surrounding the future for patent prosecution, litigation and commercial transactions involving patents in Europe. Brexit is unlikely to happen until 2019 at the earliest, following a two year period of negotiation. While the patent process before the EPO will be unaffected by Brexit, what will happen to Unitary Patents and the Unified Patent Court? How will SPCs be affected? The UK has indicated its intention to ratify the UPC agreement but will Brexit prevent ongoing participation? On a transactional level, will cross-border mergers and acquisitions be affected? Will pan-EU licenses need to be re-drafted and re-negotiated? This session will explore the current state of play in relation to each of these questions and hot topics.
